What is a separation agreement?

A separation agreement can be considered as an alternative to divorce, in the sense that it can be used for couples to reach agreement over the distribution of assets, finances and property, defining responsibilities and child arrangements. However, it is important to note that a separation agreement will not legally end a marriage and therefore it does not have the same impact as a divorce. Separation agreements can also be used for unmarried cohabiting couples. The purpose of a separation agreement is to clarify the financial and family arrangements and responsibilities, with a view to avoiding contested proceedings, in the future and speeding up the divorce process (for married couples), if the couple decides to proceed.

A separation agreement is not legally binding until it is made into a formal court order and therefore a separation agreement cannot preclude the court’s jurisdiction in financial remedy proceedings on divorce. However, providing a separation agreement is carefully prepared and negotiated, in practice, the terms of the agreement will usually be upheld by the court. This is why it is very important for parties to obtain independent legal advice when entering into the agreement.

The cost of a separation agreement depends on the type of agreement you’re getting, the court and the solicitor fees. The cost, therefore, varies on a case-by-case basis, depending on individual requirements.

With the support of a knowledgeable solicitor, you will need to negotiate the terms of a separation agreement with your ex-partner and their legal representative. Financial disclosure will be required to ensure that both parties have a full understanding of the assets available to be shared and how they intend to share them. Your solicitor will be able to assist with this disclosure as it will be an important consideration of the courts on the point of enforceability of the agreement should the terms be contested in the future. When circumstances evolve (for example, to the stage of divorce proceedings), your solicitor can assist you with making an application for a court order based on the terms of the settlement agreement so that it becomes legally binding.
